While some active compounds in the cannabis plant are federally illegal under the Controlled Substances Act, others are legal in some states and countries, and the main one is CBD…

And with all the hype surrounding CBD, with a buzz in the air about how beneficial it is for a wide variety of illnesses and conditions, people are wanting to know if it’s ok to receive their holistic medicine via mail. Obviously mailing cannabis flowers or oils is illegal as THC remains fully prohibited. However, when the CBD element is extracted, as it has no heady effect at all, it is totally legal in countries such as the Switzerland and the UK, among many others.

For now, industrial hemp, low in THC content, can be imported and shipped across State lines, but that is only if the crop contains less than 0.3 percent of THC. That said, in any event, it is almost impossible to extract high quality CBD from most hemp, and therein lies the rub. As the hemp/CBD market is so unregulated, end users don’t actually know what the quality of their product is.

The lack of proper regulation means that it’s almost impossible to ascertain the CBD content level in the product, and this has been an issue for the FDA. They said back in 2015, to a number of CBD producers, that, “Your products are not generally recognized as safe and effective. Additionally, your product is offered for conditions that are not amenable to self-diagnosis and treatment by individuals who are not medical practitioners.”

The whole question of the legality of hemp-derived CBD oil is a tricky one, and certainly one open to interpretation. And that may be why the hemp industry has grown so exponentially over the past few years, clocking a record-breaking $688 million in 2016 alone.

The legality of shipping CBD across state lines and indeed internationally is one of hot debate. And unfortunately, there are no clear answers right now, due to all the gray area amongst the legislation. You need to check your own state laws if in the US, to see how CBD is or is not prohibited. And if in Europe or elsewhere, you would need to check that country’s specific CBD laws.

There is little doubt that it’s only a matter of time before CBD as a medicine become regulated, and then it will be up to the feds, and state lawmakers to decide its legal status.

The folks over at Endoca have a great article, which is a priceless resource specifying where in America, and across the world, CBD is legal. You can read that full resource at THIS LINK.

Apologies for all the questions, I’m just excited to try and review them, and their effects. I’m a MS sufferer and also suffer from anxiety and CBD has been a god send

        Kind regards

  2. How to sensibly buy LEGAL cbd oil? Because I got a letter saying customs has confiscated my package two times already and I’m pissed.
